Regulations Governing Reporting Elementary & Junior High School Student Non- enrolment or Dropping Out and Counselling to Assist Such Students Resume their Studies

Article 1
These Regulations have been formulated in accordance with the provisions of Article 8–1 of the Compulsory Education Act.

Article 2
The terms used in these Regulations are defined as follows:
1. A student who has not enrolled: refers to a new student who without having asked for leave, or for some unknown reason, is not attending school.
2. A student who discontinues attending school (hereunder referred to as “dropping out”): refers to any elementary school student or junior high school student to whom one of the following circumstances applies:
(1) A student fails to attend school for three or more consecutive days without asking for leave, or after asking for leave that was not approved, or for some unknown reason.
 (2)  For some unknown reason, a student who has been transferred to a new school fails to report to the new school and complete the registration procedures there within three days from the transfer date.
3. Resuming their studies: refers to a student who failed to enroll or who dropped out going or returning to the school to attend classes.
The elementary school or junior high school students who fail to enroll or drop out referred to in the preceding paragraph (hereunder referred to as the “student” or “students”) do not include any student who is receiving correctional education at a juvenile reformatory school or at a reform school.
 
Article 3
The Ministry of Education shall establish a reporting system for the supervisory education administration authorities (hereunder referred to as the “reporting system”) that any school that a student attends, transfers to, or that a new student has not enrolled in (hereunder collectively referred to as the “school” or “a school” or “schools”, as appropriate for English grammar) can use to report a situation and assist with locating a student.
If any one of the circumstances set out in the subparagraphs of Paragraph 1 of the preceding article applies to any student, the reporting procedure is as follows:
1. The school shall access the reporting system and report the matter. If the student’s whereabouts are unknown, the school shall also send that student's file and case details to the reporting system to arrange for the matter to be dealt with, and the reporting system will transfer the student’s records and case details to the National Police Agency of the Ministry of the Interior.
2. The school shall send an official letter to the township (or town, city, or district) compulsory education committee to undertake the mandatory attendance procedures.
After the National Police Agency receives the file and case details referred to in Subparagraph 1 of the preceding paragraph, the National Police Agency shall provide the file and case details to each local police agency (unit) to assist them by taking part in the search for the student.  
After the local police agencies (units) assist with the search and a local police agency (unit) locates the student, it shall post a notice that the student has been found and is with that agency or unit and it shall also immediately inform the student’s legal representative and school, and it shall notify the school in writing and send a copy of the written notification to the special municipality, city, or county government.
The special municipality, city, or county government and the school shall designate a contact person to deal immediately with notifications received from any police agency (unit) and work jointly with the township (or town, city, or district) compulsory education committee undertake arrangements to assist the student who has been found to resume their studies.
The reporting of a student, assisting with looking for a student and assisting them to resume their studies referred to in these Regulations shall continue until the end of the school year in which the student turn fifteen years old.
 
Article 4
If a student is unable to attend their classes or fails to report to the school to which they have been transferred, as a result of their having a disadvantaged family background, or their family experiencing some major change, or their parents’ poor handling of parenting duties, in addition to handling the situation in accordance with the provisions of the preceding article, the school shall submit pertinent information about the student and the student’s family to the local special municipality, city, or county government for it to provide necessary assistance or welfare services, and the school may ask the local Family Education Center to provide parenting education counseling services.
 
Article 5
The school shall actively counsel the student to resume their studies, and after the student resumes their studies, the school shall report their doing so through the reporting system.
 
Article 6
The school shall provide appropriate remedial assistance with schoolwork and adaptive education measures for any student who has resumed their studies and shall list the student to be given priority access to counseling in accordance with the school’s counseling system.
 
Article 7
The school shall set up a file for the student, which a detailed record of the student, including any date the student failed to enroll, any date when the student dropped out, the reporting date or dates, contact details, counseling records, the date or dates the student resumed their studies, the circumstances regarding any further dropping out, and follow-up counseling records, and it shall review the results of follow-up counseling on a regular basis.
 
Article 8
A special municipality, city, or county government may negotiate with private sector organizations and groups to assist with follow-up counseling for any student who frequently drops out or who has dropped out for a long period to resume their studies.
 
Article 9
Special municipality, city, and county governments shall plan a multifaceted range of educational counseling measures for a student who dropped out and has resumed their studies but is not adapting to the general school education and shall provide the student with an adaptive education program to prevent the student dropping out of school again.
The multifaceted range of educational counseling measures referred to in the preceding paragraph are:
1. Tzi-Huei classes: These are classes offered by special municipality, city, and county governments set up across school districts and administrative districts for students whose families have experienced some major change or whose parents handle their parenting duties poorly.
2. Transition courses using shared resources: These are set up by special municipality, city, and county governments at one or more selected elementary or junior high school sub-districts within its jurisdiction for schools in neighboring school districts to offer with shared educational resources.
3. Collaborative transition courses: These are jointly set up by special municipality, city, and county governments, which provide the teachers and adaptive programs, and by private sector organizations which provide suitable venues and professional counseling resources.
4. Other educational counseling measures performing the same function.
 
Article 10
Special municipality, city, and county governments shall regularly supervise evaluation of the reporting of any student dropping out and evaluation of the work providing such students with counseling services after they return to school undertaken by the schools and by the township (or town, city, or district) compulsory education committees.
 
Article 11
The results that correlate with the special municipality, city, and county government matters related to the reporting of students who drop out and counseling to assist such students resume their studies shall be used as reference material when adjusting the amounts to be allocated for Ministry of Education subsidies.
 
Article 12
The Ministry of Education and special municipality, city, and county governments shall give awards to schools, and compulsory education committees, and/or their personnel that perform well undertaking reporting and counseling work.
 
Article 13
These Regulations shall take effect from the date of promulgation.
