Regulations Governing Joint Appointment of Teachers and Appointment of Floating Teachers by Schools in Remote Areas

Article 1
These Regulations have been formulated in accordance with the provisions of Paragraph 2 of Article 10 of the Act for Education Development of Schools in Remote Areas (hereunder referred to as “the Act”).
Article 2
The field of the specific expertise referred to in Subparagraph 3 of Paragraph 1 of Article 10 of the Act refers to a field (or subject, study area, or subject cluster) in which the number of class sessions to be taught is insufficient to appoint a full-time teacher.
Schools in remote areas or their respective competent authorities involved may jointly appoint a teacher or appoint a floating teacher for the field (or subject, study area, or subject cluster) referred to in the preceding paragraph, in accordance with the following provisions:
1. Based on the number of its teaching staff, a school in a remote area may jointly appoint a teacher in conjunction with other schools in a remote area. The other schools may be at the same level or at a different level or levels.
2. Each competent authority involved shall allocate part of the teaching staff quota it has for schools under its jurisdiction for schools in remote areas at the same level or a different level to appoint one or more floating teachers.
Article 3
The school at which a jointly appointed teacher has a full-time appointment is called their main school, and the other schools offering the joint appointment are called the “co-appointing schools”; the school at which a floating teacher has a full-time appointment is called their “central school”, and the other schools where a floating teacher also teaches are called “subordinate schools”. In principle, the number of schools served by a jointly appointed teacher or by a floating teacher is not to exceed three.
Article 4
A main school and the co-appointing schools are restricted to being in the same special municipality, county or city; this restriction does not apply, however, if the schools’ competent authority agrees to set it aside following consultation and discussion; the same applies to a central school and the subordinate schools.
Article 5
Each main school shall include the number of jointly appointed teachers it has in its complement of full-time teaching staff.
Each central school shall include the number of floating teachers it has in its complement of full-time teaching staff, listed as additional staffing allocated by its competent authority.
Article 6
The number of sessions to be taught by a jointly appointed teacher or by a floating teacher, and the number of their sessions which may be reduced shall be arranged in accordance with the ordinances of the main school or the ordinances of the central school governing the number of class sessions to be taught by full-time teachers; the number of class sessions that such a teacher teaches at each of the schools where they teach shall be counted in aggregate.
Article 7
Jointly appointed teachers and floating teachers who have actually served for three years or more and satisfy the following provisions may then apply to change their status to become an ordinary full-time teacher at the main school or central school who is no longer required to serve as a jointly appointed teacher or floating teacher:
  1. A main school or central school currently has a staffing vacancy because a teaching staff member is not there and the number of class sessions which that person taught in a particular field (or subject, study area, or subject cluster) is sufficient to appoint a teacher.
  1. The appointment has been assessed and approved by a teacher evaluation committee and has then been approved by the competent authority concerned.
A jointly appointed teacher or a floating teacher who has actually served for the number of years specified in the following provisions may apply for a transfer to a school other than those specified in the preceding paragraph to hold a post as an ordinary full-time teacher:
1. A teacher appointed in accordance with the provisions of Subparagraphs 1 and 2 of Paragraph 1 of Article 5 of the Act: three years or more.
2. A teacher appointed in accordance with the provisions of Subparagraphs 3 and 4 of Paragraph 1 of Article 5 of the Act:
(1) To transfer to a school in another remote area: three years or more.
(2) To transfer to a school in a non-remote area: six years or more.
Article 8
Jointly appointed teachers shall teach at co-appointing schools and floating teachers shall teach at subordinate schools that in each case are not the originally arranged such schools, in accordance with the requirements of their main school or central school, or the requirements of the competent authority involved.
Article 9
Matters related to the appointment, dismissal, suspension, and non-renewal of appointment of jointly appointed teachers and floating teachers, and the appointment terms, teaching activity matters, remuneration, insurance, benefits, retirement, bereavement compensation, severance with pay, further studies, leave of absence, assessment, appeals, and other entitlements and obligations shall be handled by the respective main school or central school in accordance with the regulations governing the handling of such matters for full-time teachers.
 
The right matters referred to in the preceding paragraph may include payment of transportation costs, in the light of actual needs.
Article 10
Each main school and its co-appointing schools, and each central school and its subordinate schools shall formulate and enter agreements regarding the administrative management and teaching support matters pertaining to jointly appointed teachers and floating teachers that involve more than one school.
Each main school and central school shall give jointly appointed teachers and floating teachers written notification of the content of any agreement, of the provisions of the Act, and of these Regulations.
Article 11
When a main school, or central school, or such a school’s competent authority undertakes the selection of a jointly appointed teacher or of a floating teacher, it shall give explicit details of the rights and obligations, the nature of the work, and other relevant information regarding each particular teaching position in the selection related information material.
Article 12
A special municipality, county, or city level competent authority may formulate supplementary directions, in accordance with the provisions of these Regulations.
Article 13
These Regulations shall take effect on the date of promulgation
